Trademark Registration in India – Overview

A trademark is a unique word, name, symbol, logo, or combination that identifies and distinguishes your goods or services from competitors. In India, trademarks are governed by the Trade Marks Act, 1999, administered by the Controller General of Patents, Designs & Trade Marks (CGPDTM).

Trademark registration grants you exclusive legal rights to use your mark for your specific goods/services, preventing unauthorized use and giving you the power to defend your brand in court. Once registered, you can use the prestigious ® symbol.

At InteLegal Consultants, we provide end-to-end trademark registration services — from the initial TM search to final registration certificate — ensuring your brand is fully protected.

Frequently Asked Questions

What is a trademark and why should I register it?+

A trademark is any unique sign (word, logo, slogan, shape, sound) that distinguishes your goods/services from others. Registration gives you exclusive legal rights to use it, prevents others from misusing your brand, and lets you use the ® symbol. Without registration, protecting your brand in court is much harder and costlier.

How long does trademark registration take in India?+

The TM application number is issued within 1–2 working days of filing, letting you use ™. Full registration (certificate issuance) takes 18–24 months in a straightforward case. If there are examination objections or third-party opposition, it can take 36 months or more. InteLegal proactively manages your application to minimize delays.

Can I use ™ before my trademark is registered?+

Yes. The ™ symbol can be used as soon as you file your trademark application. You do not need to wait for registration. However, the ® symbol can only be used after you receive the official Registration Certificate from the IP India Trademark Registry.

What if I receive a trademark examination objection?+

An examination objection is raised by the TM examiner and must be responded to within 30 days of the date of the Examination Report. InteLegal prepares a detailed counter-statement addressing the grounds of objection with legal arguments, evidence, and prior use records. If the objection is not resolved, we represent you at the TM hearing.

What is the difference between trademark objection and trademark opposition?+

A trademark objection is raised by the TM Examiner during the examination stage — before publication. A trademark opposition is raised by a third party after the mark is published in the Trademark Journal (within 4 months of publication). Both are handled differently but InteLegal supports you through both situations.

How many trademark classes should I file in?+

You should file in all classes that cover your current and reasonably foreseeable business activities. Filing in only one class leaves your brand unprotected in other areas. InteLegal recommends filing in every relevant class from the start to build maximum protection. Each class requires a separate government fee payment.
