Application is filed electronically on the official IP India e-filing portal. You receive an application/acknowledgment number within 1–2 days, enabling use of the ™ symbol.

A TM examiner reviews the application for compliance. If objections arise, an Examination Report is issued and we prepare a detailed counter-statement within the 30-day deadline.
Once accepted, the mark is published in the official Trademark Journal. A 4-month opposition period follows, during which third parties may raise objections.
If no opposition is filed (or opposition is resolved in your favour), the TM Registry issues the Registration Certificate. The registered mark ® is valid for 10 years from the application date.

Yes. The ™ symbol can be used as soon as you file your trademark application. You do not need to wait for registration. However, the ® symbol can only be used after you receive the official Registration Certificate from the IP India Trademark Registry.
An examination objection is raised by the TM examiner and must be responded to within 30 days of the date of the Examination Report. A trademark objection is raised by the TM Examiner during the examination stage — before publication. A trademark opposition is raised by a third party after the mark is published in the Trademark Journal (within 4 months of publication). Both are handled differently but InteLegal supports you through both situations.
You should file in all classes that cover your current and reasonably foreseeable business activities. Filing in only one class leaves your brand unprotected in other areas. InteLegal recommends filing in every relevant class from the start to build maximum protection. Each class requires a separate government fee payment.
